Gary Mitchell, Trevizo’s attorney, denied charges by claiming the baby was stillborn (a state of which a baby is born dead) due to the unnecessary use of drugs (mainly morphine) used by the nurse.
The verdict: An autopsy concluded the baby’s death as a homicide. It was estimated that the baby had been alive for three hours since Trevizo’s abandonment.

Trevizo was sentenced to 16 years for murder and tampering with evidence.
Released on bond: Later, Trevizo was released with a $100,000 bail bond
